First Verdict Of The Day

(Unofficial way of saying that Fed Ex won the civil case and will not owe any money after the trial this week in Wise County.)

My source is impeccable*: Complete secondhand hearsay.

Edit: Getting comments about there being a "high/low agreement." If so, it works something like this (with completely made up numbers): Prior to trial the lawyers agree to a low figure of $200,000 and and a high figure of $1,000,000. If the verdict of the jury is anywhere within that range, it stands. If less than $200,000 the Plaintiff gets $200,000. If more than $1,000,000, the Plaintiff only gets $1,000,000.  It's a way of putting some absolute certainty into the jury system.

Actually, I heard there was a "high/low" agreement prior to trial. Plaintiffs will still get the "low" agreement, but obviously not the amount they wanted.

High low--that's cool! Plaintiffs' will get something. Hopefully it will not all be eaten up in attorney's fees and expenses.

Completely the mc's fault...Fed Ex trucks have that funny sticker on the back...you know, the one that says "This truck makes WIDE turns"...it even has a diagram showing the truck crossing lanes.
The mc, unfortunately, decided to go WIDER than the truck...and into oncoming traffic...

And yes, they should have taken the initial settlement, but greedy, bloodsucking, parasitic ambulance-chasing lawyers...(not YOU Barry =D ), talked the plaintiff into shooting for a big payday...

No... Mc driver didn't go into oncoming traffic. No hi/lo offer either. But, out of genorosity and respect for the family, FedEx did give them some money anyway. Too bad their lawyers will get half!

3:28 The actual plintiff is dead. I guess it is his family suing. Prolly had kids maybe. It is a very tragic situation, that can be laid to rest now, hopefully.

MC guy didn't pull into oncoming traffic. Both were taking a left, MC behind FedEx BigRig. After completed left turn, FedEx swung far left to make a wide right, thus hitting and running over MC man. No eye witnesses. FedEx driver leaves scene to get lawyer. comes back 25 min later. If he wasn't at fault why did he leave the scene? He left a dead man in the middle of the road for someone else to find. Disgusting. Should everybody get money if they lose a loved one? No. But the driver wasn't arrested or even given a ticket.

as far as the police report goes, the driver left the scene of the accident, only to return with his lawyer(s) 20-25min later while police were investigating. whether or not he called 911 prior to leaving, I don't know.

There is no where to "pull in". You don't move your vehicle when you've struck someone, you don't tamper with evidence.
