Breaking News: President Obama has determined that the Defense of Marriage Act is unconstitutional, and that the Department of Justice should no longer defend the measure, which severely limits the potential of states to honor or carry out same-sex marriages, in court, the administration announced Wednesday. I would be in favor of letting gays marry if I thought they would shut the hell up. If you give a mouse a cookie...

People stand up for what they believe in, and when that stops happening, God looks around and says, "there are no more righteous people here, I no longer have a use for this place". See Sodom and Gomorrah. If the elected populous which makes the decision to put a stamp of approval on homosexual marriage truly reflects "we the people", then look for some raining fire in the near future. This is a bad decision from a horrible leader.

Interesting. Under orders from the executive branch, who determined that the law is unconstitutional - an act usually reserved for the judicial branch - the DoJ is not to defend a law passed by the legislative branch. That's portentous. This has probably happened before. Anyone know when?

Good point Tommy. I say if you want your "partner" to lead you around Wal-Mart naked and on a leash it shouldn't matter. That's your private business and it's not hurting anyone. (Please note the dripping sarcasm.) Does this country no longer have a moral compass? What's next? Mandatory recognition of animal/human marriages? Some things are just not natural. It has nothing to do with hate or being a homophobe. (I have good friends who are gay.)

Anonymous said...

You'll convince me that marriage is really seen as a holy sacrament when the divorce rate isn't so high. Hell, Republicans love to trade in their wives. Isn't Joe Barton on his third? I bet he votes against gay marriage because he thinks God is against it.

I have a great idea......

If you oppose gay marriage and you are a man, then don't marry another man. If you're a woman who opposes, then don't marry another woman.

Aside from that, just leave the ones that want to alone. If you think they are going to burn in hell, then so be it. It's not your job to save their soul. Just worry about yourself and you will be fine.

This is not surpising at all. I think at this point, Obama has abandoned all of his advisors. I bet you start seeing alot of people in that administration jump ship pretty soon. He's off the reservation at this point.

If administrations stop defending duly passed laws that they don't like, regardless of the issue involved, we're all in trouble.

This has probably happened before. Anyone know when?

Sure, every time a Republican president de-funds social services or orders programs that receive federal funds not to discuss options that have been specifically declared as constitutional by the supreme court.

Both Bushes did that for abortion.

Tommy,

Nobody said anything about not liking people because they are gay. Re-read the previous posts. There is a reference to the Almighty not approving of unrighteous behavior, but that's not the same thing. No parent stops loving a child but most parents at some point don't love some aspect of their child's behavior. And as for worrying so much about "peoples [sic] private lives", the reality is that this blog reported on a public event that may well have an impact on every single citizen in the United States to the extent that recognition of gay marriages is a very complicated matter. Because of the Full Faith and Credit Clause in the United States Constitution, State A should recognize the gay marriage of Surge and Valenzio when those two show up in State A after relocating from State B. Because of the way that insurance regulations, pension plans, probate laws and a host of other laws and regulations are worded now and have been worded for close to a century, premiums for health and life insurance for heterosexuals will increase when the plans they are in suddenly become forced to cover gays and lesbians and inheritances will be altered as well. Additionally, while most baby boomers understand Social Security to be a pool of money that they probably won't live long enough to tap into, that prospect becomes even more worrisome when "partners" who have never contributed to the workforce suddenly become eligible for benefits they have been denied since the program's inception. So really, as long as an entire group of people's private lifestyle has an impact on my own financial wellbeing, pardon me, please, if I have an opinion about how the government reacts to that lifestyle.

12:57....if by off the reservation you mean out of wise county, you are right.

As you may not be aware, the USA extends far beyond the wise county borders. Most of the people either support gay marriage or they think its a waste of time to make laws outlawing it, even if they don't agree with it in principle.

I really think we have more pressing matters to worry about than a few homos getting married.

Anonymous said...

12:56
Your attitude is the reason our country is going down in a ball of fire. If nobody is accountable for their actions then soon there will be no one to hold them accountable.

This "it don't effect you so mind your business" mentality is sinking the ship. I can't think of one action that doesnt have an effect on another person.

mzchief said...

BRAVO! Obama finally uses some common sense!

The government has no more right to dictate the gender of the people who enter into a marriage, together, than it had to dictate the race of the two people who entered into a marriage. Miscegenation laws were determined to be unconstitutional and it is obvious, to EVERYONE who views same sex marriage with an unbiased perspective, that denying homosexuals the right to enter into a same sex marriage is just as much a violation of their rights as it was of couples who wanted to enter into a mixed race marriage.

Churches have the right to deny a religious wedding ceremony to ANYONE based on ANY reason but the government does not have the right to deny two consenting adults/people who meet the age requirements of the state in which they are being married the right to be married.

12:49 Several things: 1) You should look up the difference between sarcastic and facetious. Sarcasm implies contempt (though I suspect that's what you meant). 2) Comparing gay marriage to animal/human marriage IS decidedly hateful. BONUS: When you say "I have good friends who are gay" in a post that makes that comparison, everyone knows what that means. You are not absolved.

Anonymous said...

I think this is a brilliant political ploy by the president and the democrats to further marginalize the Republican minority.

Anonymous said...

If every man on the planet but me turned out to be gay, would my old lady let me do my part to keep the species going? Thinking. Thinking... GO HOMOS!

wordkyle said...

Please provide evidence for the "Republican Presidents did it" line. Although it may be true, your previous claims have lacked credibility. I'm asking specifically about laws that have been negated because the President deemed them unconstitutional. There are clearly a lot of regulatory items that are under the President's control, but my question is about laws. Bush's defunding of international abortions in 2001 is even called "a reversal of Clinton administration policies." Not a law.

Anonymous said...

Wow, I kinda agree with Wordkyle. While I could care less if gays marry, declaring something unconstitutional is a power vested in the judicial branch, not the executive branch. The executive branch is to enforce laws. Here, it is deciding not to perform its function (they can't actual "rule" on the constitutionality).

Anonymous said...

I bet if our fore fathers ever thought this would be an issue there would have been a ban gay marriage clause in there.

I have, for the entirety of my adult life been a Libertarian/Constitutionalist. I have no problem acknowledging and applauding when a politician, regardless of their party affiliation, makes a decision that grants people more individual liberties and is in the best interest of the United States.

I have extremely liberal social beliefs and am equally conservative when it comes to fiscal matters. One thing, regarding the government, of which I am absolutely certain; the less choices, rights, money the government takes from Americans the better off are ALL Americans and the United States.

Religion has absolutely no place in government/politics. Quoting Biblical text is equally as unacceptable/ignorant as quoting Qur'anic text in an attempt to dictate the decisions regarding US laws and civil rights. Keep in mind, if you insist on interjecting religion into the legal/judicial/legislative procedure within the US there will come a day you will be fighting over which religion gets to dictate the laws of the US.

Being homosexual is just as much a state of being as is a person's race. I assume you are heterosexual. Is there ANYTHING that could be done to make you ONLY sexually attracted to a person of your own gender? Probably not. That being the case, how can you possibly assume/know for certain that a homosexual person has any more control over whether or not they are sexually attracted to people of their gender than you have control over your sexual attraction to people of the opposite gender than you?

LLDQFan said...

mz: "Being homosexual is just as much a state of being as is a person's race." That, of course, is still unproven. If the law says marriage will only be between a man and a woman, no ones rights are violated. It applies equally to everyone regardless of your orientation: you can only marry someone of the opposite sex and you can't marry someone of the same sex. Equal application. The law doesn't care who or what you are attracted to nor does it have to.

Keep in mind, laws were passed that only granted rights to white men thus denying those rights to Blacks and women. History and the law has proven those discriminatory laws were unconstitutional. Granting the right of marriage to a couple comprised of only a male and a female does indeed, by it's very nature, constitute sexual discrimination.

Just because, long ago, a discriminatory law was enacted and has been enforced for centuries does not mean it is right/fair.

I guess we should determine why the government sanctions marriage in the first place. If it is to help stabilize the society by providing households with legal bindings, then the government has a right to recognize the unions it chooses. If it is just to honor a religous belief, then again, it has the right ot recognize the ones it deems legitimate. If it is just to appease certain aspects of the society, then why not recognize all of the unions, or none of them? Why does the government involve itself in marriage in the first place? I truely would like to know.

#2 Baptists will not damn you to hell. God will do that based on your willingness or lack thereof to conform to His laws. It's actually your choice. (I'm not Baptist)
#3 You do have the freedom to marry the one you love as long as they are of the opposite sex. You have the same freedoms that a hetero has. Marriage is gender based, not who you love or are attracted to. I love my truck, so should we redefine marriage to accommodate me to be able to marry this inanimate object. This is craziness.

Okay...so here's what we've got. After two years in office, Obama gets to unilaterally repeal DOMA. Why now, seemingly out of nowhere? There's been no indication ever that he thought it was unconstitutional. In 2008 he wanted it "repealed," which supports the argument that he believed in its legality.

Could it be that, since his side (unions) is getting clobbered in the public's mind, and he's being attacked by both the right and the left, he needs a good "wedge issue" to divide people again? And at the same time pay off one of his constituencies?

The Donald said...

So, the Supreme Leader has now anointed himself as the top arbiter of the constitutionality of laws?

All we need now is another "wedge issue" to distract from our budget deficits. Another attack on state's rights will only increase federal power. President Obama is NOT the Supreme Court and should let the judicial branch decide this matter.

Playing politics, instead of being a leader, will only continue to divide us.

adam said...

If conservatives care about the Constitution than they should support the Obama administration's actions regardless of how they personally feel about gay marriage. The act clearly violates the Full Faith and Credit Clause:

‎"Full Faith and Credit shall be given in each State to the public Acts, Records, and judicial Proceedings of every other State. And the Congress may by general Laws prescribe the Manner in which such Acts, Records and Proceedings shall be proved, and the Effect thereof." -Article IV section I U.S. constitution.

Keep in mind, this decision does not make gay marriage legal. It does not mean that states have to grant gay marriages or even recognize gay marriages from other states yet. The Obama administration will still enforce the law until it is repealed or found unconstitutional by the court. The Justice Department simply announced that they will no longer defend the act in court where a lawsuit has been brought again it because it clearly violates the Constitution. This type of action has been done by many administrations before.

Anonymous said...

In today's judicial climate, nothing "clearly" violates or upholds the constitution. Modern lawyers have so convoluted the constitution that we no longer know what the definition of is... is.

The second amendment clearly states that the right to "keep and bear arms shall not be infringed". But, you libs don't believe that so how does the gay rights issue seem so clear to you when gay is not mentioned in the constitution even one time?
