Very Few Cases Go To Trial . . .

. . . it's even rarer for one to be retried after a reversal on appeal. I think that's whats going on today in Decatur.

I'm under the impression that it's against the law to employ an illegal in Texas. If so, then the jury SHOULD have been allowed to hear that information. I geuss the law is askew if you're an illegal. TOTAL B.S.!!!!

Just goes to show how far the TX Supreme Court will go to undo a big plaintiff's verdict. How sweet of them to be so concerned about hurting the feelings of an illegal alien truck driver who killed four Texans. They should be ashamed (if they had any shame, that is).

It may be against the law to employ an illegal immigrant in the State of Texas but, if an employer receives what “appears to be” legal documents as required by the I-9 for employment the employer is not required by state law to verify the authenticity of the documents.

CERTIFICATION ON THE I-9

I attest, under penalty of perjury, that I have examined the document(s) presented by the above-named employee, that the above-listed document(s) appear to be genuine and to relate to the employee named, that the employee began employment on __________ and the to the best of my knowledge the employee is authorized to work in the United States.

The case was reversed because the illegal alien information was erroneous and prejudicial.

9:59 Think about this.

The driver had to have a CDL driver's license. Did the police run his license at the time of the accident?

Surely, the State of Texas didn't issue a so called illegal immigrant a CDL license.

Companies should have their assets seized if they hire illegals. Then we would not have the illegal problem - they would all head back to Mexico. This asshole trucking company would have to hire all American citizens and the unemployment rate would drop. They would have to pay higher wages and charge more for their services but we could pay more because there would be fewer citizens on welfare. That would lower the federal, state, and local budgets. Therefore each of us would pay less in taxes because the governments would not need as much money. In another area, hospitals could charge less because they would not be providing free services to illegals driving trucks nor for the unemployed American that he displaced when the trucking company hired a Mexican citizen.

Seize the assets of a few homebuilders, those of a couple of meat packing plants and a couple of trucking firms and the illegals would walk back to Mexico. Just think what would happen with the arrest of two homebuilders, one meat packing plant owner and a couple of owners of lawn mowing companies in the Dallas/Fort Worth area? We would not have to worry about our teacher to student ratios. We would not have to provide medical care and education, police and immigration officials to chase illegals, etc., etc. We would not have to spend millions of dollars on deporting them - they would deport themselves when no one would hire them.

If you hire an illegal alien and that alien has a wreck and kills an American family the driver and the employee ought to be held liable.

11:04, how is the fact that he was an illegal alien prejudicial? It's a fact, is it not? I hope this jury whacks 'em again, only harder.

11:07... You are a moron, sir. All you need is one legal Messican with a birth cert/drivers license to obtain a dozzen others. I bet there's prolly 5,000 Jorge Garcias registered in Wise county... Surely you're not as gullible as you let on to be.

11:12, don't forget that the cost of the house would go up, and the quality of the house would go down.

11:48 Whose the moron? Your suggestion of how the state issues licenses is the most idiotic thing I've seen.

You are CLUELESS.

How about the state not verifying the status of the United States citizenship of an individual when applying for a driver's license. Think I'm wrong? Better think again. I know for a fact that is how they get thru.

11:51, wrong - the homebuilders, meat packers, trucking companies, and lawn mowing companies want them here. All you greedy people living in your mcmansions built with illegal labor want them here. If you lived in a house built by your fellow Americans you would have to accept less square footage due to the labor costs (like enough wages to pay health insurance and hold out for income tax and social securtiy). On the other hand your income tax rate would be lower because the formerly unemployed Americans who were taking from the government would have jobs and be paying the government.

mmmmmm.....

I hired white guys to frame my house which ended up being the most out of square crap ANYONE had ever seen. The framing crew boss went on a hunting trip right in the middle of the job and left his piece of crap workers behind who didn't show up for days at a time which took forever. WORTHLESS

I hired a Hispanic Roofing Company and Hispanic brick layers and got fantastic workers, clean jobs and worked until the job was complete. NO PROBLEMS.

Hey 11:12 and 12:48!

Send me your worthless, I mean wonderful white people who are willing to work. I'll be happy them a job. When they don't show up, have too much drama, not fullfill the job or fail the required drug screens I'll send em back to you with stamp on their foreheads that say HIRED AND FIRED.

Anonymous said...

1:05, sounds like you went with the low bid and that is what you deserve.

1:11, by your writing skills and use of the English language you sound like you are illegal: "I'll be happy them a job", "send em back to you with stamp on their foreheads". Yep, you are Mexican.

A skilled framing crew member should be paid around $20 per hour instead of the $7 to $10 per hour that your contractor is paying the illegal. If they try to hire an American citizen for $7 per hour they might get someone who can't use a hammer. And if they are paying their crew members $20 per hour then the amount they have to bid the job to you is turned down. The fact that they can get a skilled, drug free illegal for less than they can get a skilled, drug free American citizen is the reason the illegals are here.

1:05 oh yeah that's what it was, a low bid. LOL Spewed coke everywhere over that one. LMAO you keep on believing that, RETARD.

Ever been to the DMV in Decatur? I think one of those girls is on crack. They don't verify paper work! The State should be liable for giving him the cdl..

Just another example of the accused has more rights than the victims they kill!!! Justice my ass.

I didn't see the relevance of the illegal status in the case and didn't understand why the judge allowed it. But also the judge wouldn't allow the accident report as evidence where the officer stated in the report that the woman was at fault. The judge also wouldn't allow the driver's cell phone records as evidence, which showed that her cell phone was in use at the time of the accident.

Texans are addicted to the cheap labor that illegal and legal immigrants provide. And if you don't believe that the please go visit any local construction or oilfield jobsite.

Honcho, travel much? American's are addicted to cheap labor. Go to Seattle, go to Buffalo, go to Denver. Cheap labor everywhere these my good man! This is not unique to TX.

LLDQFan said...

11:42 It's prejudicial because, yes it is a fact, but it is irrelevant as to the cause of the accident and when brought to the jury's attention, if any jury members despise or hate illegals, it taints their view of the entire case no matter what the evidence shows or proves either way.

wetback or not he shouldnt be liable for an accident that wasnt his fault, and neither should the company that he worked for.

Anonymous said...

Weren't the family members originally awarded like a couple million dollars in punitive damages from TXI?

Anonymous said...

the wetback is responsible since his actions caused the accident and if a company cant figure out if a wetback is legal or not then how can they be trusted to figure oout if they should be allowed to drive a large truck loaded down on our roads i hope the plantiffs win again it is a sad situtation all around and more proof that we need stricter immigration laws in the state of texas to prevent wetbacks from being employed and draining the system dry
