That would be .708. Where's a book-in photo when you need one? (Edit: The Smoking Gun is all over it, and she doesn't look that bad. Double Edit: Oops, old photo. Triple Edit: And by not "that bad" I mean she doesn't look hammered.) .08 is the legal limit in most states although it's normally tough to tell if someone is obviously drunk at that level. Most DPS experts say that a person will, at .04, lose "the normal use of one's mental or physical faculties" but that's just crazy. I've been doing this criminal justice business a long time, and I don't ever recall someone being over .40. In fact, I've had less than a handful of cases that are greater than .30. Most DWI cases are between .10 and .19 if there is a sample, and seeing a case greater than .20 is pretty rare.

The mugshot IS one taken on an earlier case (also involving intoxication)--I didn't catch that at first. I don't know if you are just saying she's not TOO bad looking irregardless. In any event, I'm sure her blood sample was drawn due to health/medical treatment reasons because she was comatose and the medics would have to start determining what was going on when she brought in.

I thought most people passed out around 0.30 and died somewhere around 0.40?? How is it possible to keep from passing out long enough to continue drinking enough to get your BAC that high?? Probably something wrong with the device. Still...

Hopefully you will never experience loosing a loved one becuase of a impaired driver. I inly hope you keep making money off their arrests and trials.

Bad machine. She would at best be comatose (if not dead) at that BAC. Do they retain blood samples so that they can be retested? Or, do they discard them after they complete a test?

When I worked in the metroplex I arrested a guy in his mid 50's, alcoholic, had been drinking heavily since he was 15 years old, he told me.

He blew a 0.45. Could still walk and talk, though not very well. Tested him on two machines because we couldn't believe the result.

He was an American Indian. Sure liked his fire-water.

1990, a hispanic male with the last name of "Martinez" (provided so that the jail records confirm this case), from Bridgeport was placed under arrest upon probable cause of DWI. The arrest was made by a young, educated and one year experienced deputy on 114 East of Bridgeport. The 66 year old driver was almost released because he performed very well on coordination tests. @ that time a very young & educated DPS Trooper Stacy Harris assisted the deputy and administered the HGN. The suspect only had a 35-40 degree onset of nystagmus, he was considered to be around a 0.12 breath a/c. @ the jail he checked 0.488 & 0.492.
The INSTRUMENT was checked by a barage of practice tests and passed, blood was taken because of the level to require medical observation. The results (not in the jail files) were breath a/c = 0.511. That amazed everyone, p/c for stop - failed to signal left turn @ Pecan Orchard Road.

If the legal limit is .08 why do you go to jail at .08 so I think the legal limit is .079 just saying but I don't know just thinkin??????
