Officers Enter Bars To Make Public Intoxication Arrests

IRVING, Texas -- The Texas Alcoholic Beverage Commission has taken its fight against drunken driving to a new level. TABC agents, along with Irving police, targeted 36 bars and clubs Friday, arresting some allegedly intoxicated patrons before they departed the businesses. . . . Agents arrested 30 people Friday night. Most of the suspects now face charges of public intoxication. (Full story). Sometimes I think we have too many law enforcement officers. (And any chance the TABC picked on some low rent bar instead of one that regularly serves Dirty Martinis and Amstel Light?)

Can't do this. Fine if it's outside, or as someone is getting into their vehicle. But inside a privately owned establishment? How about the guy that has way too many in the hotel bar, then goes up to his room? Will the police assume he might drive soon, therefore make the pinch? Will the police follow someone home from the beer barn, wait a couple hours until they are drunk on their own couch, then arrest them on the "what if" that person decided to grab the keys and get more beer? Sad that the police are limited to finding drunks once they have already endangered the public...and there is some logic to this idea. But it can't be while inside private property. Let them come outside first, or nab them in the parking lot. This way won't hold up in court.

Irving is losing thier Dallas Cowboy Football Statdium ... how else are they going to re-coup that money.
Why dont they just arrest / beat up Gay Guys at the local highway rest stops and get them to pay fines ...

I agree with 'all cattle no hat'. I don't understand the legality of this deal. My heck what are they thinking? They could do that every night at every bar and make a killing.

Firts of all, a bar open to the public is private property but, is concidered to be a public place. No different than the grocery store or church building. Second, it is against state (Texas) law for a bartender to serve alcohol to an intoxicated person. So legally, if you are in the bar legally intoxicated, both you and the bartender have violated the law. I disagree with the way this may have been handled, but it is legal.

To comment on a statement from all cattle no hat, youare safe in your house as long as you stay there. Once you walk outside, you are in a public in public view and are fair game.

The reason for these stings is to catch the bartenders that serve too much alcohol. This cannot be done by waiting outside. The officer has to observe the bartender serve the intoxicated person. If the bartenders would follow the letter of the law, there would be no drunk drivers leaving bars.

Barry knows this. Once again he is standing on a soap box singing the blues.

Okay, I am soooo confused, don't most people go to the bar to have some drinks and get intoxicated?!?! I said most, I understand there are those that don't drink and just go to dance or whatever...but, please! I do not agree that the bartender or the establishment should be held responsible, each INDIVIDUAL should be held responsible for the decisions they make. How in the world could a bartender possibly keep track of how many drinks he/she is serving to a person anyway? I'm not saying that there should not be laws to protect the public from people who make the wrong decisions because there should be, but to hold anyone besides the drinker repsonsible is ridiculous!

What does it matter! first it wasn't in a hotel so lets throw that out. Second who cares if they were arrested inside or out. If an officer waits for them outside that is just delaying the inevitable. A drunk person in the bar has got to leave sometime when they stop selling alcohol (2am). The way I see it the officers did them a favor by cutting them off and allowing to shorten there time in detox so they can start there jail time.

3:02 AM : Actually, three people were arrested at a hotel bar -- and they were registered at the hotel. I don't care how you spin that one, that's just wrong.

TABC claimed they "were a danger to themselves and others," yet they weren't going anywhere...!? ..except to their room, after a few drinks!? Yeah, that's fair...! NOT!
