Terms Of His Probation




Not that anyone cares, but the cost per month of the SCRAM device is, I think, around $300 and the ignition interlock is probably around $80. That's on top of a probation fee which is either $60 or $80 a month in Tarrant County.

First off I think this kid belongs in jail longer and is a POS but our probation laws are stupid. Once a man has done his time he should be free to go, rebuild his life. Most people would never be able to pay those fees and end up right back in jail. It's a stacked deck and just creates a situation where you can never get back on your feet. Jail people for longer periods but give them a chance once they have served their time!

Argument in the office this morning: Can you be charged and convicted of dui/dwi if your sitting in a parked car with keys in or out of the ignition? Example: too drunk to drive home so I sleep in my vehicle sitting in the drivers seat. Use these scenarios, keys in and engine running, keys in and engine not running and no keys in ignition.

Scenarios above: State has to prove you were "operating" a vehicle on a public road. There are lots of cases w/dudes passed out at the wheel at a stop light or on the side of the road and it's often easy to prove they were operating on a roadway. If you're sitting in a parking lot, you can still get arrested but they'll need to be able to prove you had been operating "while intoxicated." If you were too drunk and chose to sleep in your car you should be fine unless the engine is running- then they may hook you up.

I'm right there with you on this one. I'm a law and order person, but once the sentence is done, let them try to get on their feet. I've had employees in that situation and all the fines and other things they have to pay just overwhelms them. I don't feel sorry for them for what they did, but the state and local governments trying to make a quick buck on this is unfair in my opinion.

I don't believe he will be able to comply with all the terms of his probation for the next 10 years - which means he will be back in custody before too long.

Ethan Couch got off easy and deserves severe punishment. I suggest somehow getting his name on Scientology's mailing list. They will never give up trying to extract money from him. By the way, Scientolgy now advertises on Barry's favorite radio station. Yup

Probation usually is the sentence. He would have been on straight probation had he not violated. Very few people on probation have done actual prison time in Texas.

The difference between him and your employees is that he is rich and doesn't have to worry about being overwhelmed. Mommy pays all of his bills.
