- I'm not particularly bent out of shape by the Hurst officer's treatment of the kid that has made the news recently. I'd suspend him for a couple of days, but that's about it.
- The Texas Supreme Court approving forms for simple divorces is something I didn't think I would ever see.
- I saw a lady testify in Wise County's district court yesterday who had the most high pitched and irritating voice I've ever heard. The whole place just stopped down when she uttered her first sentence.
- TCU has a good team as they sit at 7-4. But let's face it, if they were in their old conference, they would be 11-0 and yelling about being shut out of the BCS Championship game.
- I've had several people mention that Michael Morton article in Texas Monthly (links below). I've been bothered ever since I read it.
- Man gets life sentence for DWI in Texas. (It was also his eighth conviction and his blood alcohol concentration was a shocking .446).
- Had a client take a prison term plea bargain yesterday after she had been out on bond. I've said it before, but those are bad days at work no matter how fair the plea bargain.
- Every time I feel smart watching Jeopardy, they'll hit a category of literature or science and I then feel dumber than a fifth grader.
- Our Christmas decorating is always delayed by the guy who we are willing to pay to get up on the high roof to hand the lights. Inside decorating is delayed because I hate to pull out what was once a beautiful fake tree which has been destroyed by The Family Cat.
- I've got a DWI trial today barring a last second change of plans.

TCU would not be undefeated in their old conference. They lost 20players before the season and their starting QB. Patterson has done a great job keeping them competitive, considering this is their weakest roster in several years.
I think TCU is just thankful for what they have after losing Pachall midseason. But watch out next season!

I refuse to do Christmas anymore...65 years of it is enough already. Wish I could have done that years ago. Such a waste of time and money. It's not our birtday,,why do we get presents.
If anyone is still curious about D.Malone, you should go to Weatherford Democrate fb page and read their story. It explains why the murder was premeditaded murder. And also makes you wonder why she went back to him after such a brutal attack a week and a half before her murder. Makes me sick.
I'd be OK if they fired the Hurst cop. He's a loose cannon. There will likely be others come forward and say they have had needless confrontations with him. A huge liability for the great city of Hurst.

I think the Hurst cop needs an attitude adjustment...should be investigated to see if he is like this all the time or was it an isolated event. Hey we all have bad days.
Barry, what happened with the complaint filed a few years back by the Texas Bar (I think) against the folks who offered on-line simple legal forms? The complaint was that the business was illegally practicing law in Texas. It was LegalZoom & Robert Shapiro had some money invested in it.

Agree with RJ. It's not that this incident was necessarily excessive force, it's that this cop doesn't have the judgment or temperament for the job. I think it's only a matter of time before he causes a serious problem, whether he's still in Hurst or not. Hurst ought to gut their losses.
(But I'd disagree on the "great city" of Hurst. What's that smell?)

This Hurst officer does need to lose his job. There is already someone else coming out saying that he mistreated them during a traffic stop for speeding.
How long until he really causes some huge problems for Hurst?

Given the enormous backlog that the family law courts have in places like Harris County - and AWFUL forms generally available online for pro se litigants - approving some forms seems like a great idea.
The last thing these judges want is to have to see the same petitioner trying to prove up a default divorce for the 17th time because they went Legal Zoom.

I don't think the Hurst cop did anything bad. He reacted odd because he was on camera. You never know just how odd or bad you look on camera until you see it on TV. Just look at Ben Afflek, Tom Cruise, or that guy who Dances with Wolves.

I'm going to have some pro se Appeal forms printed up, and leave them lying around courthouses. Let the courts of appeals deal with the pro se litigants and see how they like it. Include a section on Evidentiary Insufficiency as a Matter of Law on every last one of them. Maybe another section about the fringe around flags being a symbol of maritime courts.
Baylor Too: You know, the Family Law courts are already backed up with pro se litigants.
The difference is that with accepted forms for the simple agreed divorces with no kids, the prove-ups will go smoothly.
As it stands now, pro se litigants use handwritten forms or stuff they dug up online and judges have to keep seeing the same petitioners over and over again as the petitioners keep trying to come up with something acceptable for signing.
I'm not sure what you think they'd be appealing. You can prove up a divorce by having the petitioner testify to a dozen quick points like date of marriage. If these forms are ONLY for agreed divorces (as the article says), what would anybody be appealing?
Katy - I'm curious. You're evidently an expert on family law courts. Will this also affect courts of general jurisdiction? And will the pro se litigants know the difference between community and separate property or will they subscribe to the what's his is his and what's mine is mine even though (traditionally) she has stayed home throughout the marriage and he's accrued a 401(k). And that the colts from his high dollar separate property horses are now community? And she may be a victim of domestic violence and will qualify for spousal but she won't know that.

Oh, my appeal forms wouldn't just be for divorces, it would be for anything. Criminal cases, foreclosures, man-bites-dog, you name it.
The fact is, when the Supreme Court endorses forms, it minimizes family law practice to fill-in-the-blank--at least in the mind of the litigants. And so people see even less value in hiring a professional to do the job right. Even people who can and should afford attorneys will balk at the fees and try to handle cases themselves. And so you eventually set up a two-tier system. There'll be your Vanden Eykels, doing divorces for the upscale people in Highland Park; and then there will be Bobby Joe and Bubba, doing volume divorce practices out of virtual offices and doing a crappy job at it. And it won't just be the lawyers who can't make a living who are hurt, it will be the entire system: people who can't find a decent attorney to represent them and more backlog in the courts.
2:51: Most of my information came from the article BG linked to, which you are able to read as easily as I was. But the key is that these are AGREED ORDERS with no kids and nothing in dispute. If they're both signing off on an agreed order, why would characterization of the property matter? if there is something in dispute, then the forms would not be sufficient - although believe me, folks will still try to do it pro se...
I've seen those "lawyer forms" you "lawyers" claim the public is not capable of using themselves.
