Holy Cow! He Really Is The Decider! (AKA "The Scooter Commuter")


President Bush, who is against activist judges, gets active in the criminal justice system by "commuting" the prison term of Scooter Libby. Wow.

Edit: And anyone remember then Gov. Bush's statement when he declined to even give the now dead Karla Faye Tucker a 30 day stay of her execution?: " "When I was sworn in as the governor of Texas I took an oath of office to uphold the laws of our state, including the death penalty. My responsibility is to ensure our laws are enforced fairly and evenly without preference or special treatment . . . . She was convicted and sentenced by a jury of her peers. The role of the state is to enforce our laws and to make sure all individuals are treated fairly under those laws." (Thanks to a local lawyer for reminding me of that.)

5:12: It isn't Armitage either. If you read the trial transcripts (plus Fitzgerald's subsequent filings), it is painfully obvious that the whole thing was done at Cheney's direction.

No one actually thought Libby would spend time in prison, did they? This administration sees Law as a tool to be used to further their own ends rather than a set of rules that should govern (and punish them for) their conduct.

ok, ok. I'm not going through all of this again. I already debunked all the many red-herrings in this case on an earlier thread (e.g., Libby did nothing wrong, other people leaked the same information, Plame wasn't covert, Fitzgerald was a liberal on a witchhunt, etc).

You wing nutz who still claim Plame was not undercover (covert) please read the deposition from the CIA (who should know) that she was, indeed undercover. Revealing her role with the CIA did do harm to the CIA and to her various contacts throughout the world.

But all of that doesn't matter in this case. Libby was convicted of lying and obstruction. A jury was convinced. A judge sentenced him. An appeals court unanimously denied Libby bail while he further appealed and ordered him to prison. So this law and order administration is quite selective on how the law is applied. Oh yes, could this be a form of presidential interference in judges’ decisions?

Bush "commuted" (is that legal?) the sentence just to keep Libby from talking and nailing the real criminals in so many activities.

Just like everything else in this administration, the rules apply to everyone else...but not to them. This action is just more standard Bush and his "Good Ole Boy" cronyism. (Horses & disasters...they're all the same aren't they?)

No matter how incredibly offensive it is, we shouldn't be surprised. When the Libby sentence came down I set the odds of our sitting President pardoning Libby (convicted in a court of law...with the best defense money could buy...by a jury of his (not so wealthy) peers) or commuting the sentence at 3:2.

At least most of the "upstanding citizens" that hold that office wait until they're almost out the door before performing that sort of garbage.

Libby was NOT convicted of leaking Plame's identity. He was convicted by jury for lying to the Grand Jury. Who was the leaker has NOTHING to do with this issue.

I am actually giddy with joy about this because it just goes further to show how thoroughly CORRUPT this administration is. They have NO regard for the law.

Bush, when releasing his comments, (on paper as he was unwilling to do it in person) said that he was using his constitutional authority to commute Libby's prison sentence. He acknowledged the crime by letting stand the probation and $250,000 fine. But then Bush probably ad-libbed that he did this because the prison sentence was too harsh. Unfortunately, the sentence is in fact quite in line with guidelines for this offense. By his adding his opinion on the length of prison time he might have overstepped his commutation authority and claimed he is the ultimate "decider" of what any and all sentences should be. He continually amazes even me with his stupidity.

We haven't heard from wordkyle and the wing nutz yet. So let me help with the subject of commutation of sentences from the DOJ manual on Commutations...

Section 1-2.113 Standards for Considering Commutation Petitions

" A commutation of sentence reduces the period of incarceration; it does not imply forgiveness of the underlying offense, but simply remits a portion of the punishment. It has no effect upon the underlying conviction and does not necessarily reflect upon the fairness of the sentence originally imposed. Requests for commutation generally are not accepted unless and until a person has begun serving that sentence. Nor are commutation requests generally accepted from persons who are presently challenging their convictions or sentences through appeal or other court proceeding."

So Bush can't even get the commutation procedure right.

A couple of notes:

Some of the posters here ridicule Bush's procedural handling of the commutation, but I'll bet the sentence stays commuted.

Fitzgerald's sentencing recommendations go on and on about the "serious criminal investigation" -- which turned up no convictions other than Libby's. Not only was no one else convicted, no one else was even charged.

Libby's paying the price for the rabid anti-Bush atmosphere generated by the Democrats and the media. But the most cherished dream of Liberals ("Wouldn't it be fun to see Karl Rove frog-marched out of the White House in handcuffs?") remains unfulfilled.

Between this and the absolute collapse (lower approval ratings than Bush!) of the Democrat-controlled do-nothing Congress, you guys must be about ready to slit a vein.

No one wants to comment on Bush's total hypocrisy on commuting Libby's sentence after his pontification on how it was his job as governor to uphold the court's decision on a death penalty case? How many other cases has he chosen not to intervene but he jumps right in for Libby (only to keep him quiet).

From George Washington to George W. Bush presidents have exercised their Constitutional Authority of pardoning whomever THEY bloody well please. As indicated in the link listing only the "notable pardons" there have been a trainload of presidential clemency actions.

Since George H. W. Bush, it has become COMMON practice for a president to grant clemency to members of their administration/friends who were attacked for political purposes.

Libby is an ABSOLUTE FOOL for having not JUSTIFIABLY used the life/career saving line "I do not remember." rather than GUESS at what he "remembered." I would like to BELIEVE that had Libby INTENTIONALLY made false statements he would have done a BETTER job. People BASHED Alberto Gonzales for having a faulty memory but they did NOT attempt to send his booty to the big house for "inaccurately remembering."

Karla Faye Tucker participated in an action that resulted in the DEATH of an INNOCENT person. Libby participated in an activity that MAY have resulted in the death of an innocent person. I find it disingenuous for you to on the one hand rail against the DUI laws that send people to prison for what MIGHT have happened while operating a vehicle with a BA of .08 and on the other to expect someone to spend years in prison for having a "faulty memory."

Partisanism in ANY situation eliminates MOST people's ability to remain OBJECTIVE.

Incidentally, I still think POLITICIANS SUCK.

More proof of the lack of common sense in America!

Was there ever any doubt in the mind of anyone out there that this was going to happen. I just wish that Bush would have came out and said what we all know; which is no matter what you convict him of he ain't going to jail. The fact that anyone could be shocked by this decision is quite shocking to me!

What is sad on top of all of this is how much money did this cost tax payers to to prosecute him. The result would have been the same, except now Libby will write a book about his experience and make back his money 10 fold!

For those who do not understand politics it is simple....Both sides do crooked things to get and stay elected, when one side is in control they have more power so they protect their cronies! The other side has less power so they do whatever they can to attack, prosecute, vilify, demean, and disrupt the side with power. With all of this comes scandal and it irks me to think people forget the nature of politics!

Two points:

1)If I mislead the FBI and ie to a grand jury and get caught, my but is goingto jail. It don't matter what my intention were or if I did another wrong, I'm going to jail.
2) This is STILL ther most corrupt and contemptable adminstration since "Tricky Dick" Nixon, and that's saying alot when you look at the laws that Reagan deliberatly broke.

They all hate Bush and everything conservative (you make it a point to single out Nixon and Reagan, two conservative repubs); never anything bad about all of the bad things Clinton and Carter did (and, in cartr's case, is STILL DOING);
then you attack conservatives like wordkyle, who has said before he disagrees with a LOT of what Pres. Bush has done/is doing. He makes no bones about it. However, the vast majority of liberals refuse to think outside their own hate-bush-filled box and see that both sides of the aisle are corrupt, not just the republicans; that in itself makes all of your arguments disingenuous;
Are there things I don't like that Bush has done? Yes! Are there things he has done that I like? Yes! Do I think he's doing the best he can? I don't agree with everything Bush does, but I support him as our President. Personally, I think anyone lying under oath should go to jail...especially politicians and lawmakers! The punishment should be severe enough to deter dishonesty...even if they have to lock up everyone in Washington...

Actually, I think our school board could do a better job running this country than our congress...

Bush might be stupid but his lawyers are a little brighter. They give a commutation of Libby's prison time while leaving his conviction in tact. This keeps Libby quiet while still leaving a club over his head till Bush/Cheney can get out of town. Crooks covering for crooks.

Hillary's position does not have as much to do with timing as it does with who is in the audience and who is headed to the slammer.

Hillary is cut from the same cloth as is Bill in that they say what NEEDS to be said to get what they want. Who TRULY knows what either of those two chameleons stand for and mean?

I think it is great YOU moved the discussion to the FUTURE rather than remain mired, like so many other people, in the Bush vs. Clinton is the biggest jerk debate. That debate is much like trying to figure out which turd smells worse. What people forget is that regardless of it being Bush or Clinton they BOTH are turds who smell like poop.

Bush is Bush and Clinton is Clinton, what we need to do is START finding out about the dirtbags (admittedly that MAY have been harsh.) running in 2008 so we are not stuck with a turd for another 4 years.

10:07 your Hillary quotes are interesting, but don't really show us anything and don't assist your intended point of making her look hypocritical. It's perfectly reasonable for a person to believe that we should reduce prison penalties for ALL non-violent offenders and yet abhore the special treatment received by ONE very rich and politically connected offender.

I don't know about you, but I would like for us to strive for a judicial system that doesn't provide this sort of special treatment. There may be a lot to point out as being wrong with Hillary but this just isn't one of them. Better luck next time.

I suppose importing cocaine is not a violent crime and not commited by a "very rich and politically connected offender". Surely these guys deserve "special treatment" since they didn't lie to a grand jury.

Sorry, but there is no accountability in big government any more... not right or left... I'm just tired of being lied to... There is no justification, whatsoever! These guys are all dirty; and if they're not, it's seems to be a matter of time.
