The cops stopped this new couple the other night and, after smelling alcohol on the Vaughn's breath, investigated him for possible DUI. The most amazing thing was that they let him go. (I think the law is in Texas is that an officer smells alcohol on your breath, then you must be arrested, but I'm not sure about that).

I was stopped once going from Dallas to Austin on a Friday night. I was drunk and was tailgating and making a complete menace of myself. The cop stopped me and did the sobriety tests where you have to count your fingers backwards and forwards. I ACED that but the standing on one foot and etc I failed horribly. I had 2 dogs in the car and I think that is why he let me go. He did give me a ticket for following too closely. I learned my lesson and didn't drink and drive again.

Barry,

You of all people know it is not Texas Law. Just because an officer can smell the odor of an alcoholic beverage on or about a person doesn't mean that an arrest is going to happen. People are released every day after passing field sobriety tests even though the officer detected alcohol.
