I agree with the tort reform, I've always thought that loser pays is the best way to go and would decrease frivolous lawsuits. I don't know if it's an emergency.
Tort reform is a bogus issue because there's simply not a tort problem in Texas any more. Courts are not clogged because of the number of personal injury lawsuits pending in Court.
Tort reform is only an issue because Perry wants to appease his buddies at TLR (Texans for Lawsuit Reform), which is a front for the insurance companies. TLR wants you to think it is a grass-roots organization, protecting the interests of small businessmen, but really it is all about protecting the insurance companies.
Surely if this "emergency" legislation passes, our insurance rates will go down! Or am I again getting Texas confused with La-La Land?
Insurance companies already own the regulators, the legislature, the governor's office, and the Supreme Court...why not just go ahead and give 'em the keys to the courthouses, too?
In a civilzed and reasonably-safe society, you must have either strong governmental regulation or a strong civil justice system (or a working combination of both) in order to deter dangerous actions or products and provide meaningful compensation to the injured. Texas doesn't have the former and barely has the latter, and it's just getting worse. This would be bad enough if we had universal health care, where at least the injured could always get medical treatment, but we don't have that, either. So good luck to the next guy who gets hurt or killed by someone's negligence. I'm sure Rick Perry, Phil King and others you probably voted for will be happy to explain how your misfortune helps keep Texas "open for bidness."

Tort Reform is not a problem in Texas and hasn't been for years now. The only courts that are log jammed are the Criminal courts and that's mostly from drug busts and petty crime that could easily be gotten off the books by negotiating a plea bargain or in some cases, dropping the case altogether. Perry is crying wolf because that's what he is being told to do. SHAMEFUL.

This would make it much harder for people to bring suit. Texas has one of the best Open Courts doctrines in the country. The problem is not the laws, or the system, necessarily. The problem is that judges are very inconsistent in their rulings. I have judges in the Golden Triangle tell me all the time that they know there's no evidence of something, but they want the jury to decide. Democrat judges in Harris County make entirely different rulings than the Republican ones.
We need to change the way judges are elected/appointed, not switch to the English System of loser pays.
The system is not back logged, either. A recent study by the Office of Courts Administration showed that very few courts are overworked. In Fact, here in Harris County we've begun switching some courts from civil to family, or family violence. And some criminal courts to specific things like mental health or veterans' courts, at least part of the time. In many counties, especially rural ones, you can go into any court room on any given day and the chances are that it will be empty.
Leave the system, except for the way we decide who will be the judge.

Our Justice system sucks...you have illegals deported and banned from the country getting cdl's with fake ssn issued by The Texas Dept. of Public Safegy (thats a joke) and still driving an he kills a family of 6 and he is still behind the wheel, You commit criminally negligent homicide and you walk with not so much as a slap on the wrist?...steel a cow go to jail, steel a horse you go to jail, you can still get behind the wheel of a car after 3 DWI's they are allowed to roam the streets as if no one died. The victims of these worthless human beings they have no rights!!! No blood drawn on a fatality accident automatically because it violates the persons writes that caused the accident? Leave it to the discretion of the trooper? Well I have been the victim of a lying trooper before!Amazing he didn't show up to court when contested and the case was dismissed..think it was cause he lied and I could prove it? Bullshit every one involved should have blood drawn. The victims in this damn country have no writes. Its the criminals that get all the damn rights. The whole system is one big f'ed up mess. From the president on down. All you crooked politicians, and law breakers. Your time is coming! Go out and pee in public see if you dont go to jail but kill some one you will probably be safe.....This is one crazy messed up country. Our forfathers would be turning in their graves right now to see how far the country has gone down the shitter!
