The No Body Murder Case


Story on closing arguments this morning.

A Denton jury is on the clock. A high school Civics class would acquit this guy in five minutes.

(They actually misspelled his name in the headline.)

Edit: At 9:24 p.m., the jury returned a guilty verdict. Stunning is not even close to my reaction. I'll bet my house it will be reversed on appeal because even with the standard of "reviewing the evidence in a light favorable to the State, no rationale jury could have found the defendant guilty", it will happen. But this verdict should scare each and every one of you.

Amazing. Shocking. Wait..........a better term........Idiocracy.

I hope he is found not guilty, but to tell the truth I don't really trust juries. I'd hate to have my life in their hands.

Why are you so obsessed with a case that does not have a body? Jimmy Hoffa is still missing. According to you, that means he's still alive. Do you plan on knocking off Mrs. LL? Do you think that you have the perfect place to hide her body? If no, get over it.

I was in Boy Scouts with Charles and 6 years in the same schools...he is an odd sort but was generally nice. I have been following the case and it seems to scream reasonable doubt. If he did do it and set up the circumstance of leaving her car in his driveway to be found the morning after she was at his house to talk divorce stuff...he's a lot smarter than I ever thought.

Actually you get arrested for allegedly killing people...you get convicted for actually killing people. Once the verdict comes in the "alleged" goes away.

Mmmm....it is strange that her car was left in his driveway when she disapeared.

Also, wonder what kind of farm animals he has on that farm? Pigs?

Surely, the police have searched every inch of the farm for clues.

5:21pm and there's no news of a verdict. I wonder how long the judge will keep the jury tonight? Waiting for a verdict is one of the hardest parts of being a trial lawyer.

Fox 4 says Stobaugh was found guilty. That scares the living hell out of me.

After I posted my last comment (Fox 4...) I saw that you had updated the bog entry to reflect the guilty verdict. See, I told you back in my comment at 2:49 this afternoon--juries scare the hell out of me. Three times out of four they will unconsciously side with the prosecutor because he is perceived as an unbiased public servant sworn to "do justice."

The judge out to enter a jnov, but he has to face the electorate, so most of them don't have the balls to do that.

This really does scare the hell out of me.

One more comment and then I'll leave it alone for tonight. I stated in another comment that one of the hardest things about being a trial lawyer is waiting for a jury verdict. Well, there's something even harder: having to move directly to the punishment phase of a trial when you believe your client was wrongfully convicted. (Apparently, Stobaugh elected the jury to decide punishment, since the sentencing phase of the trial is scheduled to start tomorrow at 11am.)

Essentially, you have to go back in front of the jury with your hat in your hand, acknowledge that the jury didn't buy your theory of the case, swallow your pride, and try to persuade them to be lenient to your client. You don't have time to lick your wounds or drown your sorrows.

I can't believe it. That jury should be ashamed. Regardless of why she is missing (is she dead?), there is zero proof he did anything to her.

The Stobaugh verdict was wrong, wrong, wrong. I feel sorry for his kids. And, don't think there is not a possibility the woman is somewhere with a man who has helped her disappear.

Those prosecutors are going to be rock stars over this conviction, at least until the case is overturned on appeal. I bet they will be asked to speak at the next prosecutors convention.

Just another comment pushing the generality that I have heard over the years that Baylor lawyers are pretentious a-holes.

Just a generality of course...I don't buy into it yet. I know a lot of Baylor lawyers who are too professional to post such a thing on a public website.

Anybody in the legal profession should know better than to second guess a jury when they haven't sat through and heard every word in the trial. Are most of yall relying on the newspaper for your information on the case or what?

The DRC says the defense lawyer tried to call Stobaugh during the punishment hearing. What kind of dumbass would do that? Is he trying to set up an ineffective counsel appeal?
