And Another (Wait. What?)



This one is a little tricky. He is accused of engaging in sexual conduct with a high school student who is 17.  In Texas, that wouldn't be a crime but for the fact he is a teacher and she is a student.  And it doesn't matter that he doesn't even teach on her campus (he's a middle school teacher; she's a high school student.)

Edit: Wait a second! This is obviously a political prosecution by conservative, right wing local authorities who just got mad because they say this on his Facebook page . . .

They're not at the same school?
The statute says "enrolled in a public or private primary or
secondary school at which the employee works"...

My guess is that these cases - where not cut and dry - are probably open to some further definition and challenge...

He'll probably get off.

Well, I mean, according to the facts, he already got off twice, but I mean... You know what I mean.

why should it be any different just because the teacher is male? It should be more severe. A female student can be somewhat passive, but a male student has to possess a certain amount of, uh...willingness, for almost any activity to occur. Granted, sometimes all it takes is a slight breeze, but still...

Maybe if he had kept it in his pants for another year, he could have avoided becoming his cellmate's ginger snap

The the law about imporoper relationship between an educator and a student is admittedly stupid. It would make it illegal for a 22 year-old substitute teacher from Fort Worth ISD, say, to have relations with her 19 year-old fiancee, who's a senior in Decatur ISD.

Meanwhile, a married city mayor or councilman of 60 years of age may pick up a 17 year-old girl from the bus lane at high school, if he so chose, to do filthy things with her, and it would be as legal as Christmas, provided he's not an educator somewhere.

Penal Code 21.12 is a 2nd Degree Felony. Remember when we hung felonies only on really, really bad crimes?

That said, the stupid law is on the books, and I don't think that people should be pointing at the people enforcing the law, to point out the stupidity of the law that someone else enacted.

Texas now has more than 2,400 felonies on the books, including most recently a new 3rd degree felony for misrepresenting the size of a fish. Ten of those felonies involve oysters. In the last session the Texas created 53 new crimes, up from an average of 39 (per session), over the prior decade. You'd think at some point the Legislature would run out of things to criminalize, but not a chance. When God sat down to author His list of forbidden acts ... He could only come up with ten.

The law has been changed.

It now applies to any student in the same district.

Appears to be unconstitutional -- I can see limiting an authority figure's unfair influence over a kid at his/her own school, but not across town --

And let's be honest. It was already a crime to misrepresent the size of a freshwater fish. This legislative session just added saltwater.
