Supreme Court Wire

Held: A state cannot enact a statute that imposes the death penalty for the offense of child rape. The death penalty is forbidden for crimes against individuals that do not result in death. A 5-4 decision with the swing vote being Kennedy. (Opinion in pdf format here. HTML version now up here.) And they still didn't release the 2nd Amendment case today. They are born showmen. (It'll be released tomorrow morning.)

Hmmm. I kind of agree with the Court on this one. While child rape is a bad thing, It doesn't seem like you should be killed for it. I think a just punishment for that crime would be to rot in a prison cell for the rest of your life with a 300 pound gay black atheist as a cell mate.

I have to quit reading this blog. It's turning me into a leftist.

Is there anyone on death row for rape right now? I know in the mid-90's, there were two in Louisiana. If they are still on death row, what happens to them next?

10:44 Get a grip. Nobody said we didn't want to "hurt" someone who committed child rape. Just that we won't be executing them. You may not agree with the decision, but that doesn't give you the right to mis-state and exaggerate it.

Plus, the death penalty on a rape case gives the criminal no reason to leave the victim alive.
I'm not sure a criminal would think that way, but they might.

Kennedy forfeited any claim to respect or credibility when he cited European disapproval of a previous Supreme Court decsion as a basis for his opinion in Lawrence v Texas. At the same time he downplays the importance of stare decisis, which is fundamental to the concept that America is "a nation of laws, not men."

In other words, Kennedy believes that the SCOTUS has the right to make things up on the fly.

This "evolving" Constitution that the Supreme Court insists upon following is sickening, and dangerous.

Well, at least a woman will have the peace of mind knowing that if her husband rapes her child, there's no worry of him being executed -- as long as the kid's just banged up.

I guess the parents of these rape victims will have no other choice but to take matters into their own hands now.......seeing as how the Supreme Court denies the victims the appropriate enough form of justice!

One rationale for not imposing the death penalty for crimes where the victim is not killed, is to encourage the offenders not to kill their victims. Children obviously are even more susceptible to being eliminated by the perpetrator to help get rid of witnesses. The death penalty is not the only way society has to deal with criminals.

It's rather obvious that justice in America will disolve partially because of the growing number of morally bankrupt judges.

Oddly enough, they all seem to be lawyers...

the problem is, its not the supreme court's place to tell states how to enforce theyre own laws unless it violates the constitution. seem if they bann the death penalty under "no cruel and unusall punishment' that they would have to ban the death penalty for any crime.

12:24 - I think you are right about parents taking things into their own hands. Many folks just wouldn't care if they were locked up for life if they witnessed anybody messing around with their children or grandchildren and stopped them.....permanently.

The SC is nothing more than a reflection of the majority. It does not interpret the Constitution. It does what is expedient. It will screw the 2nd ammendment tomorrow, not because it is the right thing to do but becuase they can't put the Jennie back in the bottle at this late date. One more example of expediencey.

The court in limiting capital punishment isn't so against capital punishment, but it clearly knows that that punishment is not always leveled fairly and accurately. (see Dallas County)
So it does what is expedient.

And it makes a wonderful whipping boy for politicians and idiots when it doesn't bless their warpped sense of the world view.

In the states trial against this animal, the state's expert witness who is a child forensic expert, he said that it was the most violent rape of a child that he had ever seen. A surgeon had to operate on the child to repair the damage. Are you liberal weenies happy?

Us Conservatives never do any sex things that are harmful, mean, aginst the law, or nothing. Us Conservatives do not WANT our weenies cut off, cause it would make it harder to pee, but take off them BALLS and just give us harmone pills, and we will be happy, cause we do not like sex anyway. Well, sex with our GUNS maybe. OK, Fantasy sex with our President Bush, or still (RIP) C. Heston.
