Don't Sell Your Gun Rack

Supreme Court just said the 2nd Amendment has meaning. But, wow, it was 5-4. PDF version of opinion is here. HTML version now available here. It appeared in either Time or Newsweek - and, look closely, that's a T-shirt bearing the logo of the now defunct DFW country station, "Young Country.")

This ruling means that people can now deal appropriately with child rapists.............because the government can't!

Not surprisingly, Kennedy is again the swing vote. Yesterday, he voted with Ginsburg/Souter/Stevens/Breyer. Today, he voted with Thomas/Scalia/Alito/Roberts. Yesterday, Kennedy was criticized by commenters on this blog for, among other things, "believ[ing] that the SCOTUS has the right to make things up on the fly." Are those of you who criticized Kennedy yesterday going to praise his wisdom today?

This decision is proof positive that Republican Judges can write new law as well as the Democrats can. So much for the phrase strict constructionist!

I do believe the document is living and breathing and must change with the times.....we certainly aren't the same country we were when we needed militias.

It would just be more honest of them all to just say, "yes, it was meant in terms of belonging to a milita (as it clearly reads) but to be pragmatic, we just can't envision rounding them up, the unrest it would cause, etc. At this point, despite how it reads we are going with the flow.

Now that would be an honest SC.
We would have our guns (I have a closet full but no AK46's) and an honest SC.

1057 - Since it was my statement you quoted, I'll address your point.

If a Supreme Court Justice bases his opinion on the approval or disapproval of a European body; AND dismisses prior Supreme Court decisions as unimportant when they don't agree with his own, then yes, I will condemn that Justice.

Today's decision was based on the 2nd Amendment of the US Constitution, not a foreign panel's opinion.

I believe that we must adjust to the times, but when it comes to the courts, I disagree that the Consitution is a "living, breathing document." There is a process to change the Constitution, and it's not SCOTUS.

Good decision by the SCOTUS. Anything less would really have given those totally anti gun folks too much incentive to go much farther in their persuit to ban all privately owned weapons.

Hey, 11:08, If the values and morals of the people of the United States change over time so that portions of the Constitution are no longer appropriate for our society, then the proceedure is to admend it or to repeal an admendment. That is how it was designed to work. If the people of the United States no longer want the states to have the right to apply the death penalty for child rape then they can admend the Constitution. It is not the job of the Supreme Court to make this decision.

after reading the entire ruling im convinced that liberals are stupid.

the desint? was based on a fireworks ban in 5 cities to prevent fires. didnt want to burn the city down, and firing a gun into the air on new years is kinda dumb anyway.

but the ruling was based on the individual right to defend himself and his property with modern weapons, not only from criminals but from a criminal government.
