- Extremely nerdy criminal law legal stuff: Last week, a Texas appellate court was faced with these questions when presented with the case of a bicyclist who was detained for driving on the wrong side of the road, and then an open container of alcohol in the bicycle's drink holder was observed: Does Texas' open container law include bicycles under the statute's broad definition of "motor vehicle"? And, if so, did the officer then have probable cause to search the rest of the bicycle for other open containers under the "automobile exception"? And, if so, does the right to that search extend to the backpack the cyclist was wearing where drugs were ultimately found? I love it.
