Random Wednesday Morning Thoughts



  • Greg Abbott during his speech yesterday: “No child should be in the wrong school simply because of zip code.” There is a very glaring problem with that statement regarding public schools. Figure it out? Answer at the end.
  • Abbott also announced a statewide hiring freeze including universities. He went Full Trump. You never go Full Trump. 
  • I think I've mentioned this before, but there is a lady at the courthouse who used to be a whiz at shorthand. 
  • Fox News was quick to incorrectly identify the killer of the peaceful worshiping Muslims in Canada in a tweet (shown below). Fox News claimed in the story, since taken down, that “witnesses said at least one gunman shouted ‘Allahu akbar!’”  Nope. He was very white, very much a Canadian, and very much anti-immigrant. 
  • Local radio talk show host Mark Davis immediately jumped on the fake news proclaiming radical Islamic terrorists were killing other Muslims who weren't radical: 
  • By the way, this morning Davis had for Tarrant County GOP chairman Tim O'Hare fill-in for him but Davis was on the phone to start the show because of the Supreme Court news. O'Hare actually asked Davis who he thought would be the next Supreme Court justice to die. Davis was horrified and wished them all a long life. 
  • And we always need to remember that evil isn't limited to race or religion or country:
  • As I think more about the two horse deaths at the Stock Show, I'm stunned PETA isn't all over them.

  • There is no worse of a magazine than The Texas Bar Journal. And to prove my point, they had an article this month written by an "expert" on "how to get noticed on social media"  if you are in a small firm or sole practitioner. The excerpt below made me laugh.
  •  "Remain neutral." Good lord. Look, people don't want a lawyer who is politically correct.  They want someone who gets out of bed every morning and cares, who is smart, and who will raise hell if the situation dictates it because they are passionate about what they believe in.  None of my clients give a rat's ass about my politics. I'm sure most completely disagree with me. But they know I despise injustice in any form, and I suspect they would be very concerned if I were "neutral" about those injustices. 
  • And anyone who fights in the trenches, who has had to hug a mother in a courthouse hallway, had to comfort an individual who is scared to death and who depends on you, and has to deal with a system which is stacked against him in so many ways, will not be "neutral."
  • Have I ever lost a potential client because of this blog? Sure. Do I care? No.

  • I'll tell you one thing about Trump, his moving the  Supreme Court announcement to prime time  for TV  complete with an audience to applaud him as he walks in was PR genius. Every other president has to be thinking, "Why didn't I do that?" And I'll admit: Trump did a fantastic job last night introducing the nominee.
  • But I bet new Supreme Court nominee Judge Neil Gorsuch went to bed last night praying that Trump doesn't get impeached for some screw-up in the future so that he won't have to suffer the notation "Appointed By Donald Trump" by his name in the history books forever.
  • As conservative as Scalia was, he was really a good judge for Fourth Amendment law. He actually understood it and provided some great personal liberty decisions. I took a quick Internet search of Gursuch last night and found he had thrown out a warrantless police  computer search in a child porn case. And he has railed against sending in the police for a kid's conduct in school (fake burping) instead of the school staff doing their job. If that makes him Scalia 2.0, I'm happy from a criminal justice standpoint.
  • And for those of you who don't follow this sort of thing, about a year ago Obama nominated a replacement for Scalia, Merrick Garland. By Senate "rule", it takes 60 votes to confirm and the Republicans would not concede enough votes to even let the nomination get to a vote. Now it is up to the Democrats to decide if they will concede enough votes which are needed to confirm Gorsuch. They may not. So will the Republicans, who have the majority in the Senate, change the 60 vote rule and require only a majority?

Given Democrats' approval of the "nuclear option," such a Republican move would be reaching across the aisle with something they all can agree on.

With Republicans in control of the White House and Congress, and Democrats vowing to fight to the death anything Republicans want to do, will the media still have the word "obstructionist" in their vocabulary? Odds are leaning heavily "no." (Unless they're talking about past Republican actions.)

Similarly, are military deaths -- invisible for the last eight years -- once again going to be front page news?

Be afraid counsellor, choose your religion carefully as there are millions of Muslims that will want you dead should you choose the wrong faith of course not all of them but millions will. Oh they will give you a chance to join them in their faith but should you refuse they most certainly want you dead as an apostate, along with the gays, the adulterers and the other "scorns on society" Dont make the mistake of believing that this is the desire of a radical Muslin, it is the desire of the typical Muslim...your with them or your against them watch and see
....

You conveniently forgot one item....

It was Harry Reid and the Democrats who created the "Nuclear Option" a few years ago when they were in charge. It would allow them to confirm him with only 51 votes, not the normal required 60.

Funny how it was fine for them to have it, but not now that Republicans are in charge!

I agree with you Barry. If needed the Republicans should do whatever is necessary to get this nominee on the court. There is a reason Obama's nominee got no attention...just like others in the last year of a lame duck president's term....it has been that way for decades. Sorry, there are some left that never bowed their knee to Obama. Obviously, the people elected Trump to make that choice rather than Hillary....for good reason!!

Point of order, 9:45. The electoral college elected Trump, not "the people". He lost the vote of 'the people' by 2.8 million votes.

You must not think much of Gorsuch if you think he was thinking (last night or at any time - ever!) that he would worry about being remembered as "Appointed By Donald Trump". If he was that shallow about his legacy, he wouldn't have accepted the job.

I was a little surprised by the prime-time coverage of it, though. When they said Trump had both finalists come to DC, I thought of what you said yesterday. I wondered if Wise County would get a sonic boom-type sound when you screamed like a little girl with your predicted reveal.
He got a good chuckle mentioning Byron "Whizzer" White's NFL career.
It would have been hilarious if they had placed a single rose on the podium, or if Trump ended his intro by saying "You're hired!"

The amusing thing about the Democrat reaction is that it can all be boiled down to the toddler tantrum "Why won't the Republicans just let us win??!!" For decades the Republican establishment gave in to that argument. Now that someone actually fights back, neither Democrats nor the Republican establishment know how to act.

Such hypocrites, for 8 years the Republicans obstructed everything Obama and Democrats including shutting down the government, not even holding a hearing for SC nominee , saying when it looked like Clinton would win that they would block everything proposed including her SC nominee, etc. etc., etc. Is it any wonder that the Democrats are whining and crying , after all they learned from the pros. PS Sadly there were several US soldiers that lost there lives in the last year of Obamas Presidency. How do I know? it was on the front page of the Star-Telegram and reported on the evening news shockingly. Try getting your head out of Fox News ass every once and a while and you might learn something

1143 - 1) Democrats completely controlled DC the first two years of Obama's reign. He told Republicans to stand aside while Democrats did as they pleased. 2) Republicans (House) passed spending bill after spending bill, which Democrats (Senate) rejected. If anyone threatened to shut down government it was Democrats. 3) Since you were so inaccurate on the first two, I'll need documentation on your other claims. 4) Odds are that you watch more Fox News than I do.

And make sure to keep up that arrogance thing, it's sure to take you far in life.

Tim O'Hare is a vile piece of shit. Was on the Farmers Branch City Council and created an ordinance to ban illegal immigrants from obtaining housing. Fought it thru the courts costing hundreds of thousands of dollars in legal expenses only to be struck down. He tucked tail and ran afterwards. Propped up by the racist scum at Northeast Tarrant Tea Party, he has made his comeback.

The problem with the FOX News mislabeling the shooter is that it won't matter what they do now. They can proclaim the truth every day (which they will not), but a good majority of the nation will not be able to reverse their opinion based on the new (accurate) information. Therefore, more focus on immigration and less focus on mental health. It's easy to suspect malicious intent, but I'd like to believe it was an honest, yet easily preventable, mistake. I'm sure I'm naive.

And blocking the Iran Uranium deal, and Hillary's selling 20% US uranium deposits to her croney with Russian ties. Those damn Republicans.

The hiring freeze only applies to state appropriated funds in higher ed. Luckily the state barely subsidizes universities so that barely affects our hiring.

I would bet that 90% of early voting was for Trump.
