Hot Texas Appellate Judge's DWI Case Dismissed


So far, most of the details I have are behind a paywall protected Texas Lawyer site so I can't repeat the whole article. But it did say the case was dismissed "In the interest of justice" and the DWI said it was because the judge didn't look bad on video.   But I love this quote from the DA: "Of course nobody believes me, but that's OK. They didn't believe Christ when he was crucified," Rene Guerra said.

Sad..none of the news articles mention she was a Democrat or the fact that another elected judge a Democrat kicked this to the curb. You can bet if it was the GOP it would be all over the news leading with a GOP Judge did this and another GOP Judge did that...and she flat failed in the test video you can now find on line!

Didn't look bad on video. Even a Wise County Jury would convict based on the walk and turn test. She bombed the hell out of that. Just sayin.

I think a jury would like to see this in comparison to my "walk the line" video. I re-read "The Big Business of DWI" and I agree it is a racket.

Today, I was threatened with jail-time. I don't think he (the prosecutor)knows his stuff.

​"With this ruling, Hidalgo County is absolutely on notice that jailing individuals for unpaid fines without first providing an indigency determination will subject the county to liability," said Mark Whitburn, staff attorney for the ACLU of Texas. "Other counties with similarly unconstitutional practices should take notice as well."
