I tried a case once where the judge was swearing the jury in and told them, "Sometimes, it seems like juries can't say the words 'not guilty.' Can y'all say 'not guilty?'"

This was a long time ago and I was prosecuting misdemeanors. The jury convicted the guy on the DWI charge.

Why didn't the judge wait for the jury to reach a verdict and then just issue a JNOV?

As long as "so help me God" is part of the primary oath taken to be a member of the Texas Bar...it should not be ridiculed when an attorney or judge believes that God helped.
