Texas Criminal Law: These Times Are Changing When The Highest Court In Texas Slaps Down Law Enforcement

The opinion was released this morning.

It begins:

It ends:

When the right wing Texas Court of Criminal Appeals tell cops they have gone too far, something has gone horribly wrong in our State.

"The right to be left alone – the most comprehensive of rights and the right most valued by a free people." - Justice Louis Brandeis, Olmstead v. U.S. (1928)

It is not hard, people that do crack will eventually give you solid probable cause. Just wait for that moment and do it by the book.

This post sounds like something the Libertarian you claim to be would post.
You need more of this if you want Libertarian street cred.

More like "the right to be left commit your crimes". Doubt that was the intent. That seems to be the primary goal of the "no more cops" movement. Careful what you wish for.

You ready to step up and take responsibility when a cop...who knew darn well something bad was about to happen but could no longer address the situation under the "new rules" (screw street instincts and all your training...just wait for there to be a victim and THEN do something)? You ready to tell that family at the funeral that their dead child is preferred over violating a criminal's right to slink about in obvious criminal mode and not be bothered?

you may point out the fact that to make it to the Court of Criminal Appeals it had to pass through the appeals court first. Therefore three wise, esteemed judges did not have a problem with it.

"...something has gone horribly wrong in our State." Shouldn't this ruling be an indication that something went right?

The point is, nothing bad had happened and there was no indication something bad would happen.

You may want to refresh yourself on the whole innocent until proven guilty thing.

Now get off my lawn.

The cops have gone too far, or this one cop went too far?

Of course you're correct WK. Barry is just an angry old man that has to complain about anything and everything.

I wonder if Barry has ever done any self-refection and questioned why he complains about dang near everything?

Stay Classy
