Speaking Of Death

Wise County has been lucky. While I was DA (1993-2000), there was not a single crime committed in the county that would have made a person eligible for the death penalty. And in the six years that I have left, that hasn't changed. (If you are interested in what crimes can cause a person to get the needle in Texas, check here.)

No "Do Overs" In Death Penalty Cases

There will be an article tomorrow about some guy on death row named Toney who was sentenced to death for a Lake Worth bombing that killed three people. I thought that name sounded familiar. Over seven years ago (right when the case was prosecuted), I fired off in a Skattershooting that I was surprised the Tarrant County D.A.'s office was able to convict him. Now it looks like he might not be guilty of the offense at all.

Re: Titans' defense tackle Albert Haynesworth (92, left) stomping on the head of Cowboys' guard Andre Gurode. The act and the resulting injury was worse than about 99% of the misdemeanor assaults I handle and probably worse than 80% of the aggravated assaults I have had on my docket over the years. Still, it just seems odd to the cops involved like a ton of people want. (And somebody got to Haynesworth quickly after the game because he was saying ALL the right things in the post game interview.) By the way, the youtube.com video of the incident is here. Edit: That earned him a five game suspension.

Now I sit in an administrative hearing courtroom in Fort Worth trying to save a guy's driver's license. This is my view from the fourth floor.

I don't think I've ever seen anything as exciting as this on Law ans Order.

As I sit in the district courtroom in Decatur listening to about ten lawyers argue pre-trial motions in some wrongful death case, I'm thankful that I gave up that area of law about 16 years ago.
