That one time that DPS almost used their krillion dollar gun boats. Side note: Can any of those guys now man a desk at the driver's license renewal office?

  • I posted on Monday a vague blurb I saw about a man being hit by a propeller at Eagle Mountain Lake, and we've now got a little bit more information. This is the the guy who was struck, and his GoFundMe says: "Kyle was unexpectedly thrown off the back of his boat while out on Eagle Mountain Lake near Fort Worth, Texas. He was backed up over and his thighs and knees were torn to shreds by the propellers."

    • The Star-Telegram says the boat's driver was arrested for Boating While Intoxicated.

  • My trademarked Something-Isn't-Right-Detector™ is going off with this story from a couple of days ago out of Mansfield. "Smith told KXAS-TV that she picked up Sasha in Grand Prairie early Sunday morning. Sasha told her mom she’d been drinking and didn’t want to drive herself. The two women were on their way to Smith’s home in Cleburne when the accident occurred. 'I said something to Sasha to make her laugh,' Smith said in an interview with KXAS. 'She leaned back on a door and flew out.'"
  • Supreme Court opinions will now be released today at 9:00 a.m. along with new days added for this Thursday and Friday. Buckle up.

  • One of the craziest members of Congress has won re-election. They don't have run-offs in Colorado.


    • She showed up last night at her victory party wearing Trump Sneakers but apparently they were knock-off sneakers so Trump didn't get his grifter-cut off of them.
  • Lots of odd people were involved in the Insurrection. 
  • The MAGA Extremists claiming Biden will be on drugs in tomorrow's debate is painfully laughable.  But it is an extra level of comedy for this congressman to pull out a line right out of Talladega Nights when he says the President will be jacked up on Mountain Dew. Video.

  • That recent Fox poll showing that democracy is the key issue in this campaign might not be as good for President Biden as I thought -- at least based on the results of this Washington Post poll.  We are the dumbest country. 
  • The Evil Empire stole the head baseball coach of the Aggies yesterday, but if you haven't seen the coach torch a reporter less than 24 hours earlier for even asking about the possibility of leaving for Texas, it's worth the entire 54 seconds.   All coaches are nothing but mercenaries, but this one is a bad guy. Not for leaving, but for lying about it so blatantly when he didn't have to say anything.

  • Very legal nerdy stuff: You won't believe how a criminal defense appellate lawyer was roasted in a Dallas appellate opinion this week for having brought the same frivolous argumenta over twenty times since the court told him they won't work. Here's the dissent where it happened. (It's a dissent because the judge thinks they need to strike guy's brief stricken and order him to try again instead of having his client's conviction affirmed). And here's a great thread on it.

Random Tuesday Morning Thoughts





This photo should have become more iconic. The lady in the car certainly was the clincher.

  • This is an interesting investigative technique by the Tarrant County Sheriff's Office: "Hey, public, we saw blood on a guy's truck after a traffic accident. Anyone know anything?"


  • Ronny Jackson is is in the news and, once again, not in a good way.
     


  • Lauren Boebert is up for election today for the first time since the Beetlejuice play scandal and switching districts. 


  • More Hooter's carnage.

  • I still don't know what I think about the Fort Worth Fire Department sending out a professional photographer every time there's a dramatic fire, but the guy can certainly take some good photos. (Facebook link.) 



  • I saw this photo along with this story.  That's a portable breath test in the photo, and the results of it are not admissible in court. So why do the police do it? I think that's a great question. Generally, I suspect police use it when they aren't sure of intoxication after performing the field sobriety tests. 


  • That's one heck of a way to pull off a Medicare scam in Houston.


  • The Evil Empire reacted to the Aggies making the World Series final.

  • Very nerdy legal stuff relevant to stuff in the news: 
    • Last week, the U.S. Supreme Court held that a federal law was constitutional when it prohibited a person from possessing a firearm if a person is subjected to a Texas domestic violence protective order ("PO").  
    • But the only reason that case got to the Supreme Court is that the federal law was triggered when a state PO was issued because there was a finding that there was a future “credible threat to the physical safety of an intimate partner or child.” See 922(g)(8)(C)(i).
    • The Texas PO triggered that federal law because Texas law required that the judge can only issue the PO if he finds that domestic violence is "likely to occur in the future."  
    • But, get this, that is no longer the the law in Texas. The requirement that judge make a finding that domestic violence "is likely to occur" was deleted effective 9/1/23.  

    • So now a domestic violence protective order in Texas shouldn't trigger the federal gun ban at all. 
  • .I told you that ransomware attack of the software that most car dealers use was a big problem. And it's not going away . . .

Random Monday Morning Thoughts




And the opinion was shockingly simple: "Our answer to the question of what police must do before searching a cell phone seized incident to arrest is simple - get a warrant/"

  • I'm not sure what Brookshires did to someone, but there were also bomb threats over the last three days in stores in Brownwood, Tyler, and Arkadelphia (AK), and Bossier Parish (LA). There were also initial reports of the same thing happening in Azle and Alvarado.

  • We've got some evidence that the elders at Gateway knew about Morris' past several years ago.

  • I bet the full story is a little more murky that just a hate crime.  "Witnesses told police that 42-year-old Elizabeth Wolf was drunk and got into a fight with a woman before taking one of her young children and pulling her underwater."


  • We had another mass shooting on Friday. Another person died at the hospital yesterday:



  • I'm telling you, there is something strange going on with the self-proclaimed smartest guy in the room. Story.


  • I haven't seen anything on the news about this incident at Eagle Mountain Lake on Saturday.

  • These announcements from statewide CLEAT always precede any news coverage. Sounds like a wild police chase in Fort Worth this morning.

  • Parts of Iowa are under water. Big water.

  • Pour one out for Hooter's in Wichita Falls.

  • Most final championship games can be classified as "must wins." I'm pretty sure the same holds true for Tennessee.

  • Back on  May 14th, there was a horrible accident in Wise County on 1810 which killed a young woman and three of her young children.  I noticed that the funeral happened earlier this month in Denton.
