- Dateline Houston. Oh, my.
- Photos from the weekend:
- The ACL music festival in Austin was a muddy mess, and this is a great photo for a lot of reasons.
- Former special prosecutor Jack Smith went to a Bruce Springsteen shown.
- Gov. Hochul is listed at 5'8". AG James' height is hard to pin down.
- The GOP thought it would be a good idea to roll out ads featuring Angela Paxton urging you to vote straight Republican ticket. First, all you think about when you see it is that Ken Paxton cheated on her. Secondly, the line that a general election is not about “the individual players” is one crazy take.
- Trump continues to go crazy.
- Tell me again that the United States will never be a socialist country.
- If you voted for him, you deserve him.
- Drugs? They were manufacturing drugs in the nuclear plants?
- Not only is this a bizarre rant, but he posted a congressman's phone number.
- Another bizarre rant -- this time about Fox News not covering his Alabama rally on Saturday night.
- That could stop its use by guys who care more about their hair than their bellies. And that's pretty much all of them.
- Very legal nerdy stuff: The Texas Supreme Court agreed on Friday to hear a Wise County case that should make every lawyer scared to practice civil law. (Court of appeals opinion here.)
- No one is listing the cause of death which is normally a bad tell-tale sign.
- Weekend Sports:
- "During"?
- A replay review turned into Inception on your TV screen.
- Anyone else irritated about the three hour scroll for a flash flood warning for the strange place of "Henderson and Henderson" during the Tech/Colorado game?
- Of course, Wise County rep. Andy Hopper was a speaker at the Anti-Muslim rally referenced below:

Random Tuesday Morning Thoughts
- I had forgotten about my gift of autographed photo. Former Fox 4 Good Day host Megan Henderson is still in California by the way.
- This was a last second advisory at 7:20 a.m. as it began to mist this morning with freezing temperatures.
- This Britt Reid accident story is already messy, and it might get messier. The cops got a warrant for his blood after the accident, but he wasn't arrested. That's unusual. If an officer thinks he has probable cause to obtain a blood search warrant then he, by definition, has probable cause to arrest. The only time I've seen someone not arrested in this situation is if they required hospitalization, but I'm not sure that's the case here. "Britt Reid had non-life-threatening injuries, the police said, but complained of stomach pain and was also taken to a hospital after the crash."
- Lots of news about a water plant in Florida being hacked where settings were changed to release an unsafe amount of sodium hydroxide. I've been preaching it for years: We are a sitting duck for some type of cyber attack.
- That being said, I'd tap the brakes on this story. My patented Something-Ain't-Right Detector™ is going off. I don't know what it is, but something isn't adding up. But I can already tell this isn't some sophisticated attack. The "hacker" utilized the water plant's own purchased software called TeamViewer which, by design, allows employees to remotely access computers and servers. (It's like GoToMyPC for those who've used that.)
- Trump's impeachment attorneys filed a legal brief citing a conspiracy website which has been full of nutty stories for years. (And they need a proof-reader more than I do: "ani-government")
- Lots of blaming go around this morning in connection with teen or near-teen suicide.
- I've made reference to this story out of Midland before, but it still astonishes me. An assistant DA moonlighted as the legal clerk for judges who presided over criminal cases his office was prosecuting including one which put a man on death row. Amazing.
- These paragraphs from that story struck a cord with me for the two points it makes: (1) Prosecutors are given a pass for their intentional and reckless conduct, and (2) defense lawyers are either to lazy and apathetic to call them out -- or they are just scared to do so.
- I'm even more confused by the $12,500 procedure than how this all happened in the first place. (By the way, I'm also very suspicious about all aspects of this story. Once again, something ain't right.)
- A plane was dumping (presumably) water on a small island on Lake Bridgeport on Friday afternoon in a fire fighting training exercise. It made a least 10 practice runs.
- There were already questions about the ridiculousness of freshman Rep. Lauren Boebert (R-Colorado) getting reimbursed by her campaign for $21,199.52 in "mileage" expense (which was reported in campaign filings on November 11, 2020). Now it's being revealed that she coincidentally paid off $18,999.36, in tax liens on her gun-themed restaurant on Oct. 22, 2020. Oh, and all this is completely unrelated to her tweets on the day of the Trump Insurrection Riot giving the location of Nancy Pelosi.
- Her BFF is at it again this morning: It couldn't have been Trump supporters who stormed the Capitol building. Sheesh. The Republican Party has been hi-jacked. (And I didn't even mention her press conference on Friday where she proclaimed this about Trump: “The party is his - it doesn’t belong to anybody else.”)
- Just saw that Patrick Mahomes is having foot surgery tomorrow and will be rehabbing for "several months."
- I started up House of Cards again and am now halfway through Season Five. I think it's one of my favorite TV shows of all time. It's like The West Wing on acid.

Random Friday Morning Thoughts
- Here's a new one. Did you know that you can receive a "federal ticket" on the LBJ Grasslands for weed possession? And it will command you to pay a pre-set, yet arbitrary, "forfeiture amount" or appear in federal court? A ticket which says "United States District Court" at the top of it? It's so crazy that I want to believe it's a scam that someone cooked up. But this website seems to indicate it's true. This is weird, and I can't believe I've never heard of it.
- I mentioned the other day about a guy who fired up a joint in front of a judge. There's video!
- Everyone knew Trump wouldn't be convicted, but there was a sliver of hope that we would get to hear witnesses. That went down in flames last night when Sen. Lamar Alexander, who was a critical swing vote, said he would vote no on calling witnesses. But he also said that the House Managers had proved the Article I of the Articles of Impeachment. But then he said he wouldn't vote to convict.
- The halftime score in a women's SEC basketball game last night was 32-2. But for a shot with less than a minute left in the first half, it would have been 32-0. Ole Miss did not score on its first 31 possessions. And that's your women's college basketball update.
- One thing I should have added yesterday when I posted a pic of Jerry Jones' yacht docking in Miami for the Super Bowl: "Have I mentioned that NFL owners have imposed a player salary cap?"
- New: U.S. farm bankruptcies jumped 20% to hit an eight year high last year. Flashback from two weeks ago:
- Coronavirus death count to date: 170. Shooting deaths in the US last year: 15,381.
- Runaway Bay, you're on deck.
- One thing I've never done is hide on the Internet with a fake name. I don't know what @TheLillyLawyer prosecutor tweeted to cause someone to out her, but the dog pile then began with her being outed and then everyone researching everything she ever said. She then deleted her account. The last one might turn out to be problematic.
- “My girls love to drink. Ain’t no telling what’s going to happen there. They are a hoot now. Good-looking, too.” - Terry Bradshaw. It's The Bradshaw Bunch. Remember when former Cowboys linebacker Thomas "Hollywood" Henderson said during Super Bowl week in 1979 that Bradshaw was so dumb that "he couldn't spell 'cat' if you spotted him the c-a." He was right then, and he's right now.
- The boys from The Ticket road in this boat in Miami yesterday as they were in town for the Super Bowl. If I heard correctly, it sells for over $1 million and can hit 155 mph. I'm serious when I say, "What's the point?" You can't fish. You can't ski or tube. You can't walk around.
- For you criminal law practitioners out there, the lead story below sounds like a really wild case. I don't know if the story is available online because the site kept crashing my browser.
