This Lady's Emotions Are Going To Be A Wreck

This lady got 35 years for dope in Wise County. I wrote a (boring) post back in September when the Fort Worth Court of Appeals reversed her conviction and granted her a new trial. I wrote then that the case might go further up the appellate chain and it has.

Today the Court of Criminal Appeals (that's the highest criminal court in Texas since the Texas Supreme Court doesn't hear criminal cases) agreed to hear our local DA's claim that the Fort Worth court got it wrong. I'm guessing she's getting closer to getting that 35 year sentence back.

If a case is overturned by a higher court, a DA should not be able to throw a hissy fit and appeal the ruling. This is ridiculousness!

No hissy fit. Generally speaking, ANY side in ANY lawsuit (civil or criminal) can appeal what they consider to be an error. There are some exceptions, of course. And yes, an intermediate appellate court's decision can be wrong just like a trial court's decision. That's what the upper level courts of appeal are for (Supreme Court, etc.). Nothing strange or unfair of here.

Without probable cause, you can not be search unless you allow it, but if you refuse, then a dog is brought in. Is a dog not considered a search? I read the appeal and the cop only decided to search after he checked her record.

It's common for the police to wait on criminal history to come back before making a decision to continue.That makes sense to most people .What do you think they keep records for, stupid?
