Background and heading are both an improvement and look great. As for the DQ thing, they'd be ignorant to forego free advertising; everytime I see that now I want a blizzard...I'm sending you my trainer's bill.

Tell Todd that JPGs are bad. Compression artifacts around text are not your friend. Use PNG. Otherwise excellent job.
can Dairy Queen really make you change it??? I mean suing is unrealistic... but, could they demand to have the logo and "Dairy Queen" removed???

Personally, I think it would look better without the Dairy Queen logo. Never did like red against a purple background.
Now Barry can you change the photo? Get one of your buddies to take a photo of you instead of the dude with the gun.

You need to go back to the white background or use bold and/or a heavier/bigger font and change the color of your links.
In other words, the new background makes it difficult to read the text thus it SUCKS...However, the new masthead is still AWESOME.
