Well a BOND amount is set ONLY to ensure that the defendant will show up in court when requested. You CANNOT use a BOND amount against someone to "keep them in jail." However, you can use circumstances such as "is the defendant a flight risk, and the nate of the crime--example being murder and such servious crimes." The two bond amounts are very different and I have NEVER seen a bond amount of 250k for MURDER! I looked through the WCSO records on the internet and saw where the Brazoria murder arrest had a bond set at 500k. I also am aware that the DA sometimes sends warrants with "pre-set" or recommended bonds to the Jail / JP's. I understand the bond amounts, however I do not understand why a PROSECUTOR would request a bond amount that would be lower than the norm.......ie: MARTINEZ that is a suspect in the DEATH of a two year old.
It depends on what Justice of Peace is there for arraignment. CA and DA warrants usually have pre-set bonds on their warrants from the presiding magistrate that had the "case" presented at the time warrant issuance took place. A new warrant bond depends on the arraigning magistrate's intake of coffee @ at the County jail @ 8:00 a.m.
Anyone know where one might find information about those who have been arrested for DWI's in the county? arrested by Police or by Sheriff Dept? Is there a list somewhere and WHAT is the first penalty for a DWI arrest? help me out if you can. THANKS
There is no doubt that what happened was bad and if she is found to have been drunk (innocent until proven guilty) then she deserves jailtime. But I am sick and tired of the hypocrites in this county painting this woman as a bad person because she made a mistake by drinking and driving. I see it all the time, open beer in a cup and a child in a carseat but I guess that's not bad because you didn't get caught. This county has already sentenced her to death and she has never been convicted. Is it because of who she hit?
8:56, you sound like the driver is the victim. Drinking and driving has been against the law for YEARS! Are you saying this driver was ignorant of that? SHE made the choice to drink and drive just as others make a choice to rob a store, pick up a gun and use it on another human being. BAD CHOICES get people in trouble, and if this woman is so "nice" then I'll have to say she was very dumb! A young girl's life hangs in the balance, most likely is over. She may not pass away, but her life is just as over if she remains in a coma. Her parents and family's lives will NEVER be the same and that is CAUSED by "your friend's" decision. ANYONE who drinks and drives in this day and age is "waving a loaded gun" at a crowd. HOW DARE you take up for that! It makes no difference WHO was hit, it was a life that was taken. Stop taking up for the driver, you sound like an idiot for that. Tell your smiling friend she made a bad choice and now she will pay. Let her be an example to others who may think it is ok to get behind the wheel after a few drinks. btw: why don't you ask your "friend" what is was that she had to SMILE about in her mug shot! THAT was a STUPID choice too! Yes, people judge, it happens all the time. Pay attention to right and wrong and try to live your life so that you don't put others in harm's way, like your friend did. Pray for Jackie! Your friend can eat, drink, speak, walk,...etc. Jackie cannot. Your FRIEND has lived nearly half a century, Jackie is only 20. Your SMILING FRIEND stayed up at a party all night and drank until she was drunk, then decided to DRIVE at 8:30 in the dang morning! Jackie was simply on her way to work, as any RESPONSIBLE citizen would be. You get it now????
Monroe was the ONLY person in the vehicle that slammed into Jackie. Monroe was the driver of the vehicle that slammed into Jackie. Monroe failed several sobriety tests after slamming into Jackie. Monroe smiles in her mugshot after seeing the damage she caused to a vehicle and seeing that young girl taken in helicopter with life-threatening injuries. EXCUSE US for jumping to conclusions! The arrest was made, the evidence is gathered, and there WILL be a conviction. Sounds to me like you are not only defending Monroe's poor decisions, but possibly you are defending your own. Could it be that you STILL have no problem with your own drinking and driving? Oh..wait, I bet you think you are tough enough to handle it. Lay off the stupidity, cuz you sound more and more like a moron! Next time, it might be you on the blog topics.
The texas law states (2) "Intoxicated" means: (A) not having the normal use of mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of those substances, or any other substance into the body; or (B) having an alcohol concentration of 0.08 or more.
Now I have NOT or NEVER said she had not been drinking. I DO NOT KNOW WHAT SHE BLEW ON A BREATHALIZER and frankly neither do any of you all because that has not been reported in any of the news stories. What if it were prescribed pain pills or something of that like that had impaired her at that time? She STILL shouldn't have been driving but would that change the way the views are? Would that still fall into your "out all night partying" theory? The whole point of my first post (8:56) was that I find it extremely hypocritical of ALOT of wise county residents on the "HANG BETTY MONROE" bandwagon when they do the EXACT same thing she is accused of but never get caught or have an accident. Monroe is accused of Intoxicated assult and has a 475K Bond for a first offense (yep that's right from what I've been told she's NEVER had any other offense) when there is a guy in the SAME JAIL who allegedly KILLED HIS SON and only has a 250k Bond. There is nothing that Monroe can do to change the horrible mistake she has done and SHE WILL HAVE TO PAY BACK SOCIETY FOR HER MISDEEDS. But that does not change the fact that 2 good peoples lives are tragically altered by this. As a Christian I pray for Jackie to make a speedy and full recovery but also for Betty and her situation facing the realization of what has occurred.
BTW, Has anyone thought about WHAT PERSON IN THEIR RIGHT MIND smiles at a book in photo? Whether it be the Intoxication or not there is something wrong there.
Hooray~ I think you are finally catching on! btw: the "all night out partying" is not THEORY! It is FACT! Maybe you should do more investigative questioning of known persons who DO KNOW before you call it a "theory." As I said before, ANYONE who drinks and drives now days can certainly be caught! It happens. And if you are going to drink and drive, you never know when it will be YOUR TIME to suffer the consequences. Sorry, I"m not on the "poor Betty" bandwagon, as you are. I have NO SYMPATHY for her kind! I hope she gets many many years and serves as an example to at least one person who might want to make poor decisions. If you or others don't want to be labeled " her kind " ......then don't drink and drive. Period!
MAY GOD BE WITH JACKIE AND HER FAMILY AND MAY GOD BE WITH THE GRIEVING FAMILIES OF THE POOR LITTLE BOY WHO DIED AT THE HAND OF SOMEONE HE THOUGHT HE WAS SAFE WITH. BABY KILLERS AND DRUNK DRIVERS ARE ALL SELFISH AND ALL NEED TO BE SENT TO A "ROUGH" PRISON AND LET THEM KNOW AHEAD OF THEIR ARRIVAL WHAT THEY ARE THERE FOR, JUSTICE MUST PREVAIL.

Doesn't some of it have to do with the flight risk?
only david walker understands all that
How many DUI suspects are flight risks vs. accused murderers.
if a dog was involved there would be no bond. straight to the big house.
Ricky wasn't smiling in his mugshot.
Who sets the bond? Were they set by the same person? Can't a lawyer protest the amount (see it all the time on Law & Order)?
MADD sets the bond amount when the charge involves an auto and alcohol. It assures that MADD gets their cut.

My comment is a joke, sort of.

I found no humor in your joke.
I maintain that a BOND needs to be set by the JP and NOT the "RECOMMENDED BOND" by the District Attorney. The District Attorney is NOT a judge!

one more thing, you say she WASN'T drunk? You're saying she was sober? Then I guess that makes the smiling mugshot even worse, doesn't it!

You are so right.
I am not defending Monroe.
She has been charged NOT convicted of anything.
